You must follow any policies made available to you within the Services.

A. Notice of Fair Use

Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
More explicitely, it is stricly prohibited to reproduce and share outside of the website any question, quiz, training material, technical content, available on Cockpit Quiz.

B. Use of Content for Operating Aircraft

The content presented on this site is not intended to replace or supersede any Official Aircraft Flight Operations documentation available to the aircraft operators. In the case of a conflict or difference between the content and the information provided in the official documentation in its latest revision, the latter shall prevail at all times.

C. Personal Data that we Collect about You

Personal Data is any information that relates to an identified or identifiable individual. The Personal Data that you provide directly to us through our Sites will be apparent from the context in which you provide the data. In particular:
When you register for a Cockpit Quiz account we collect your full name, email address, and account log-in credentials.
When you fill-in our online form to contact our support team, we collect your full name, email address, and anything else you tell us about.
When you purchase a subscription of Cockpit Quiz, we collect your email address, payment card number, CVC code and expiration date.
When you respond to Cockpit Quiz emails or surveys we collect your email address, name and any other information you choose to include in the body of your email or responses. If you contact us by phone, we will collect the phone number you use to call Cockpit Quiz. If you contact us by phone as a Cockpit Quiz User, we may collect additional information in order to verify your identity.

D. Information that we Collect Automatically on our Sites

We also may collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps and other online features and services. We use Google Analytics on our Sites to help us analyze Your use of our Sites and diagnose technical issues.

E. Cockpit Quiz Subscriptions

Cockpit Quiz is a subscription service. Members can choose to sign up to monthly or yearly subscriptions. Members can choose to swap between monthly or yearly subscriptions and self-manage their subscription. Members can choose to cancel a subscription at anytime. If a member chooses to cancel their subscription, access will continue to Cockpit Quiz until the end of that poyment period. No refund will be offered for cancellation mid-duration of a subscription term. Members can choose to restart their subscription at any time.

A Cockpit Quiz privacy policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Cockpit Quiz can use such data in accordance with our privacy policy.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in UK copyright laws.

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.
When you upload, submit, store, send or receive content to or through our Services, you give Cockpit Quiz (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services. Some Services may offer you ways to access and remove content that has been provided to that Service. Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure you have the necessary rights to grant us this license for any content that you submit to our Services.

The following terms are in relation to use of our CBT.

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Computer-Based Training (“CBT”) course (the “Course”) provided by Cockpit Quiz (“we,” “us,” or “our”) in partnership with Evionica (“Evionica”).

These Terms are designed to comply with applicable laws in the United Kingdom and the European Union, including consumer protection and data protection legislation.

By accessing or using the Course, you agree to be bound by these Terms. If you do not agree, you must not use the Course.

2. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian to use this Course.

If you are acting on behalf of a business, you confirm that you have authority to bind that organisation to these Terms.

3. Course Access and License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Course for personal, educational, or internal business purposes only for 90 days once granted access to the CBT course purchased. Access should be provided within 24hrs after purchase. Once access has been granted a further confirmation will be sent, which indicates when an individual’s 90 day access will begin.

You agree not to:

• Copy, reproduce, or distribute Course content without prior written consent
• Share login credentials with third parties
• Modify, adapt, or create derivative works
• Use the Course for unlawful purposes or in breach of applicable regulations

4. Partnership with Evionica

The Course is delivered in partnership with Evionica. Certain elements of the Course, including hosting and platform functionality, may be provided by Evionica.

You acknowledge that:

• Separate terms and policies from Evionica may apply to platform use
• Evionica acts as a service provider unless otherwise stated
• Liability between the parties is allocated contractually and does not extend beyond legal obligations

5. Consumer Rights (UK/EU)

If you are a consumer located in the UK or EU:

• You have statutory rights under applicable consumer protection laws, including the Consumer Rights Act 2015 (UK) and the Consumer Rights Directive (2011/83/EU)
• Nothing in these Terms limits or excludes your mandatory legal rights
• The Course must be provided with reasonable care and skill

Digital Content & Right to Cancel:

• Where digital content is supplied immediately after purchase, you expressly agree that access begins immediately and acknowledge that you may lose your 14-day cancellation right under the Consumer Contracts Regulations 2013 (UK) / EU equivalent
• If this consent is not obtained, you may retain cancellation rights in accordance with law

6. Payment and Fees

Where fees apply:

• All prices are stated inclusive of VAT where applicable (for UK/EU consumers) unless otherwise specified
• Payment must be made before access is granted unless agreed otherwise
• Refunds are provided in accordance with applicable consumer laws and any stated refund policy

7. User Accounts

You are responsible for:

• Maintaining the confidentiality of login details
• Ensuring account information is accurate
• All activities under your account

We may suspend or terminate accounts in cases of misuse, breach of Terms, or security concerns.

8. Intellectual Property

All Course materials are owned by or licensed to us and/or Evionica and are protected under UK, EU, and international intellectual property laws.

You are granted a limited right to use the materials. No ownership rights are transferred.

9. Data Protection and Privacy

We process personal data in accordance with applicable data protection laws, including:

• The UK General Data Protection Regulation (UK GDPR)
• The EU General Data Protection Regulation (EU GDPR), where applicable
• The Data Protection Act 2018

We act as either a data controller or data processor depending on the context of use (e.g. individual vs corporate client).

Your rights may include:

• Access to your personal data
• Rectification or erasure
• Restriction or objection to processing
• Data portability

10. Course Availability

We aim to provide continuous access for 90 days after access has been granted, but do not guarantee uninterrupted availability.

We may:

• Update or modify content to reflect regulatory or industry changes
• Suspend access for maintenance or security reasons
• Withdraw the Course where necessary

Such changes will not affect your statutory rights.

11. Disclaimer of Warranties

Nothing in these Terms excludes liability where it would be unlawful to do so, including for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation

Subject to this:

• The Course is provided “as is” and “as available”
• We do not guarantee uninterrupted or error-free access

12. Limitation of Liability

To the extent permitted by UK/EU law:

• We are liable for foreseeable loss and damage caused by breach of these Terms
• We are not liable for indirect or consequential losses (e.g. loss of profit, business interruption)
• Total liability shall not exceed the amount paid for the Course

This limitation does not apply to mandatory consumer protections or liabilities that cannot legally be limited.

13. Termination

We may suspend or terminate access if you breach these Terms.

If you are a consumer, termination will be proportionate and in line with applicable law.

Upon termination:

• Access rights cease immediately
• Continued use of materials is prohibited

14. Governing Law and Jurisdiction

If you are a consumer:

• These Terms are governed by the laws of your country of residence within the UK or EU
• You may bring legal proceedings in your local courts

If you are a business:

• These Terms are governed by the laws of England and Wales
• Courts of England and Wales shall have exclusive jurisdiction

15. Changes to These Terms

We may update these Terms to reflect legal, regulatory, or operational changes.

Where required by law, we will notify you of material changes. Continued use constitutes acceptance.
